Definition of Disability
You are protected under federal and state law if you fall into at least one of the following categories:
- You have a physical or mental impairment that limits one or more major life activitiespermanently or for a significant period of time (usually more than sixmonths). Major life activities are walking, seeing, hearing, breathing,talking, learning, working, etc. For example, you fall into thiscategory if you are deaf/hard of hearing, blind/low vision or havemobility difficulties, epilepsy, severe depression, anxiety, HIV/AIDS,cognitive difficulties or any other type of limitation.
- You have a record of a disability. You fall in this categoryif you have a disability even if it is no longer active. For example, aperson with cancer in remission is still protected from disabilitydiscrimination under the ADA.
- You are regarded as having a disability. You fall in thiscategory if you are discriminated against because others believe youhave a disability even if that’s not the case. For example, a personwith severe burns is protected under the ADA even though she does nothave a disability that limits a major life activity.
