DALP ALERT

 

The Downpayment Assistance program has had its busiest year since its inception, and funds are running low.   MOH has seen an unprecedented level of activity in our homeownership programs and is proud to have been able to facilitate homeownership for over 400 low and moderate income households this past year.  This has coincided with falling property values and an increase in the inventory of homes affordable to our first time homebuyers.  The downpayment assistance program has played a crucial role in stabilizing neighborhoods most deeply affected by the foreclosure crisis, with over half of our funds going to households purchasing short sales or foreclosures.  MOH is therefore restricting limited funds to stabilize those communities with the greatest need. 

Starting immediately (as of October 20, 2009) , the following qualifications will apply:

·     Applicants will only be eligible for Downpayment Assistance if they are purchasing properties in REO or short sales.

·     Applicants have a household income at or below 100% of the AMI

·     The new maximum loan amount is $60,000 or 15% of the purchase price, whichever is less.

Program Overview

The Down Payment Assistance Loan Program (DALP) is a down payment assistance loan to low-income first time homebuyers in San Francisco purchasing single family home in San Francisco, except for a BMR unit (Below Market Rate or Inclusionary).  The DALP is a silent second loan that requires no payments for 40 years.  The principal amount plus a share of the appreciation (profit) shall become due at the time of the end of the term, or repaid upon sale, transfer or rental of the property, which ever comes first.  DALP has been approved by CalHFA to use their first mortgages. The DALP loan will subordinate to first mortgage, DALP lien will always be on the second position of the property. 

 

Borrower Eligibility

First-Time Homebuyers:   who have never had an ownership interest in a principal residence. 

 

Meet Income Limits:    Total household income cannot exceed 120% of the area median income (AMI) for San Francisco Metropolitan Statistical Area, as established by the U.S. Department of Housing and Urban Development (HUD), adjusted annually. 

 

  • The combined income of all household members who will be living in the property must be included in the determination of income.  The combined household's income must be projected as an annual income.  It should be assumed that the current income would continue for the next 12 months, unless there is verifiable evidence to the contrary.
  • Household income requirements will include all income of persons 18 years old or older who will be living in the property.  Maximum loan limits are tied to the household income category:

Eligible Household Member:  To be considered a member of household, a person must either by (1) on the title and loan of the property or (2) claimed as a dependent on the tax returns of household member who will appear on the title and loan for the DALP Loan (spouse is not a dependent, he/she must be on the title and loan of the property).


Minimum Downpayment Requirements: The borrower must contribute a minimum of two and half percent (2.5%) from their own funds toward the purchase of the property.  All borrowers must have sufficient funds to meet the requirement downpayment, closing cost, necessary reserves and sufficient income to meet the monthly mortgage payments, property tax, homeowner insurance and homeowner association dues (HOA).

Sellers Credit:  No sellers, developers or realtors credit allow for the DALP program.

Liquid Asset/Reserve Limitation:  The combined household liquid assets after purchase the property cannot exceed $25,000. Liquid Assets includes all source of monies from savings, checking accounts, investments and properties held by any member of the Borrower’s household including minors and any fund is available for liquidation to purchase property. Liquid Assets do not include funds held in pension accounts, retirement funds, 401(k) plans, or similar assets which are not available for liquidation without substantial financial penalty to the Borrower.

 

Homebuyer Education Requirements:  Borrower will be required to complete the first-time homebuyer education course through one of MOH's 5 approved housing counseling agencies.  A certificate of completion of homebuyer education must include with the DALP loan application package.  

 

First Mortgage:   All City Loan approvals are made in conjunction with a first loan commitment from a bank or mortgage lender.  The first loan should be the maximum amount for which the buyer is able to qualify; the loan must be fixed rate, 30 year loans, fully amortizing.  DALP has been approved by CalHFA to use their first mortgage products.   No interest only, stated income, option ARM, balloon or negative amortization payment options loans.

 

Maximum Combine Loan-to-Value Ratio (CLTV) cannot exceed 97.50% of the purchase price, which include the first mortgage, the City's Downpayment Assistance Loan Program (DALP) and any other borrowed subordinate finance (CHDAP, WISH, etc.....).

 

Debt-to-income (DTI) Ratio:   Borrowers monthly housing debt, including property taxes, insurance and if applicable mortgage insurance and homeowner's association (HOA) dues cannot be less than 38% of the household's gross income.  The ratio of monthly housing cost and all other household monthly debt (includes credit card payments, car payments, student loan, etc...) cannot exceed 45% of the household's gross income.   

 

Property Eligibility

 

Properties purchased with the assistance of DALP funds must be single-family residences units in the City and County of San Francisco, which include single-family house, condominiums and townhouses.  TIC (Tenancy-In-Commons) is not allow in this program.

Maximum Purchase Price Limits:   The maximum purchase limits as of January 2009 is $625,500.  

Property Size Requirements:  The size of a household must be compatible with the size of the property being purchased.  A minimum of one person per bedroom is required.  In other words, a single person may purchase a studio or one-bedroom unit; two-person household may purchase a two-bedroom unit; three-person household may purchase a three-bedroom unit and so on. Bonus room and finished room will be considered as bedroom. The size of a household must be compatible with the size of the unit being purchased.  No in-law units will be allowed for DALP loans.

 

Maximum Loan Amount

 

The maximum DALP loan amount is up to $150,000 or 30% of the purchase price whichever is less.   The loan amount will be determined based on the borrower's income, assets, size of household and debt to income ratio.  All loans are subject to available funds.

DALP Loan Terms


1.  Loan Terms:  The City loan will be deferred for 40 years at zero percent interest and has no monthly payments.  The principal balance amount plus  a share appreciation should become due at the end of the term or when the borrower sells, rent or title transfer of the property.   The gross appreciation is calculated by subtracting the original sales price from the current sales price or the current appraised market value.  The share appreciation is computed as a ratio of the City loan amount to the purchase price, that is, if the loan amount equals 20% of the purchase price, the share appreciation is 20%. 

For example:  If you receive the DALP loan in the amount of $90,000 with the purchase price of $450,000, the share appreciation would be 20%.

Calculation of Repayment:

For example:  when you sell the property in the future for a new purchase price or appraised market value of $500,000, the City repayment obligation will be: 

 

A   Loan Principal:               $90,000

C   Appreciation Share (A ÷ B) 20%
D   New Sales Price/Appraised Value: $500,000 
E   Appreciation (D - B) $50,000 
F   Appreciation Share Amount (E x C) $10,000 
G   Total Due to City (A + F) $100,000 

2. Prepayment Penalty:  There is no prepayment penalty to pay off the DALP loan prior to the due date. The repayment amount must pay in full, which include the principal amount and share appreciation 

3. Assumable/Transferable: The City loans are NOT assumable or transferable.  The loans must be paid in full upon sale or title transfer of the property.

4.  Refinance/Subordination: The City loan can be subordinated to the refinancing of the existing first mortgage for lower interest rate and better loan term with no cash equity out of the property.  If the refinance meets the City subordination requirements, the City loan will subordinate to the new first mortgage.

Loan Documents 

After the DALP loan has approved, the commitment is good for 45 days.  The City will provide the loan documents to the title company for borrower's signatures before funding the DALP loan. 

City Deed of Trust (pdf): The City Deed secures the loan against the title of the property.  The DALP loan will subordinate to first mortgage and will always be on the second lien of the property. 

City Note (pdf): The City Note contains an acceleration clause, which will call the entire loan due and payable upon sale; rent and title transfer of the property.  The Note also outlines the terms and repayments calculation of the loan. 

Owner Occupancy Requirements

 

Borrower must occupy the purchased property as its primary residence within 60 days after close of escrow. Properties that have received DALP funding must remain owner-occupied throughout the term of the loan and never used as investments or rental property.  Compliance monitoring may be performed and documented proof of occupancy required at intervals determined by Mayor's Office of Housing.

 

Application Process

1.     Before apply for the DALP loan, borrower must complete the first-time homebuyer education course through one of MOH’s 5 approved housing counseling agencies. A certificate of completion of homebuyer education must be included with the application package.  

2.     Borrower should go to one of the participating lenders to get pre-approval or pre-qualification. 

3.     Find out the maximum first mortgage for which you can qualify, combined with your own downpayment and the DALP loan amount you can qualify, that is the maximum purchase price you can afford.  Your lender should be able to help you make a good estimate of how much property you will be eligible to buy with those combined resources.

4.     Find a property, enter a purchase agreement. You must have a ratified purchase agreement to apply for DALP loan.

5.     Once you have a ratified purchase agreement ,go back to the lender which that you are working with and must submit the following documents to the lender:

      Submit DALP application (DALP-1);

      Complete set of past 3 years Federal income tax returns (included all schedules, signed and dated) and W-2 forms.

      3 current and consecutive pay stubs with year-to-date (YTD);

      For self-employed borrowers, provide a current profit and loss statement with YTD net profit (signed and dated) and sign a Self-Employed Affidavit;

      Unemployed borrower or co-borrower must sign and notarize and Unemployed Affidavit;

      Income Tax Affidavit (DALP-3), must submit this form when apply DALP during 1/1 to 2/28. (if applicable)

      First Time Homebuyer Affidavit (DALP-4).

      Homebuyer Education Certificate.

      Last 3 months bank statement for checking, savings & other pertinent investment accounts.

•      Ratified Purchase Agreement;

      Gift letter (if applicable)

      IRS form 4506

      Application Fee is $300 (non -refundable). $400 if apply MCC together with DALP.

 

The following information will submit from Lender with DALP application package to City, the application package must bound in legal size manila folder with two fasteners.
• Transmittal Form
• Lender’s Certification (DALP-2)
• Primary Financing Loan Application (Form 1003) and

• Loan Analysis (Form1008)

• A copy of borrower's Credit report
• Approval or commitment letter from Lender
• Fair Market Appraisal
• Preliminary title report (including escrow deposit receipt, escrow officer's name and email address; and wire instructions)

 

DALP applications may take approximately 15 working days to process, review and underwrite.  Once the loan approved, we will need another 7 working days for funding.  We will be returning all incomplete applications without reviewing them.  

A letter of approval or denial will send to the borrower and lender within 15 working days of receipt a complete package.

DALP Participating Lender

Loan agents or mortgage brokers who would like to become a participating lender for San Francisco DALP and MCC programs must attend a 2-hour DALP/MCC training and sign the  Lender Participation Agreement. Each individual loan agent or mortgage broker must attend.   If you are mortgage brokers, your loan must fund through one of our participating lenders.
