Filing a Domestic Partnership Agreement
You may file a Domestic Partnership Agreement with the San Francisco County Clerk or through a Notary Public. (San Francisco Administrative Code, Section 62).
However, if you are interested in having a commitment ceremony through our office, your registration MUST be done through our office.

It is important to note that the information and requirements below apply to San Francisco's local registration process only. It is SEPARATE from the State of California's Domestic Partnership registration. Our local registration is not a marriage but a basic living agreement providing a greater benefit to City and County of San Francisco employees and/or heterosexual couples. If you don't fall under those two categories, you would receive a far greater benefit registering through the State of California; however, you could choose to do both registrations. Requirements to File with the San Francisco County Clerk

Age Both of you must be at least 18 years old.
Attendance Both partners must be present when filing the Domestic Partnership Agreement.
Legal Photo ID A valid authentic legal picture I.D. card IS REQUIRED from each partner. (i.e. passport, driver's license, naturalization form, resident alien card, military I.D.)
Previous Partner You must have filed a notice for ending the partnership with the County Clerk or Notary Public before you can file a NEW partnership agreement.
Filing Fee $45.00* - Cash, a California pre-printed check including name and address, money order payable to S.F. County Clerk, or debit card. (*price subject to change)

Requirements to File with a Notary Public
You may pick up a Domestic Partnership Agreement form from the San Francisco County Clerk and have it processed and notarized by a Notary Public. A copy needs to be given to a person who witnessed the signing (who may or may not be the Notary). Please note that if you are choosing to file with a notary public, then you are choosing NOT to file with the County Clerk's office.

Benefits:
Businesses MAY choose to include Domestic Partners in various benefit plans, but are not required to do so. It is your responsibility to check with your employers for information on their benefit policies.

Domestic Partnership Retirement Benefits for San Francisco City & County employees:
Two important eligibility criteria for Domestic Partner Retirement benefits are:
  1. The Domestic Partner must be designated as the employee's beneficiary with the Retirement System.
  2. The Domestic Partnership must be established by filing a signed Declaration of Domestic Partnership with the County Clerk; in addition the certificate showing that the Declaration of Domestic Partnership was filed with the County Clerk must be filed with the Retirement System at least one full year prior to the effective date of the employee's retirement or of the employee's death if the employee should die before retirement.
